These Rental Terms apply to all rentals from ABC Party Center ("ABC," "we," "us," or "our") located at 21 Commerce St, Chatham, NJ 07928. By placing an order, you ("Customer") agree to be bound by these terms. If an event coordinator, planner, or representative places an order on your behalf, you are still responsible for these terms as if you placed the order directly.
Payment is due in full on or before the date of delivery unless other arrangements have been made in writing. All prices are in U.S. dollars and are subject to change. Written quotes are valid for 30 days from the date they are issued. Additional charges may apply for changes in quantity, delivery requirements, extended rental periods, or damaged and unreturned items. Applicable sales tax will be added to all orders.
ABC Party Center may require a deposit or credit card on file to secure your order. By providing a credit or debit card, you authorize ABC Party Center to charge that card for any balance owed, including charges for damaged, lost, or unreturned items, extended rental periods, and any other amounts due under these terms. No discounts will be applied unless specifically noted on your order.
Delivery and pickup details will be specified on your order. You are responsible for providing safe, clear access to the delivery and pickup location, including adequate pathways for moving equipment in and out. ABC Party Center may decline delivery or pickup without penalty if the location presents unsafe conditions. You are also responsible for obtaining any permits or approvals required for use of the delivery location.
Please inspect all items at the time of delivery. If you notice any shortages or defects, let us know immediately. Once delivery is accepted without notice of issues, the items are considered received in good condition.
All rented items remain the property of ABC Party Center. Rented goods may not be sublet, loaned, or moved from the delivery location without our prior written consent.
You are responsible for the care and safekeeping of all rented items from the time of delivery until they are picked up or returned. If any rented items are damaged, destroyed, lost, or stolen while in your possession, you agree to pay the full cost of repair or replacement at ABC Party Center's discretion.
You accept full responsibility and liability for any injury to persons or damage to property arising from the use, misuse, or possession of the rented items. You agree to defend, indemnify, and hold harmless ABC Party Center, its owners, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or related to your rental, use, or possession of the items. ABC Party Center is not responsible for any damage or liability incurred by handling your personal property or the property of any third party.
All rented items must be returned at the time, date, and location specified on your order. Items should be returned in the same condition and packaging as they were received — stacked, racked, or folded the same way they arrived. Rinsing dishes and wiping down items before return is appreciated. Late returns or items not ready for pickup at the scheduled time may result in additional charges.
Orders may be cancelled up to 48 hours before the scheduled delivery at no charge, provided the cancellation is made in writing (email to abcrent@verizon.net is acceptable) and acknowledged by ABC Party Center. A cancellation is not effective until acknowledged by us.
Cancellations made less than 48 hours but more than 24 hours before delivery are subject to 50% of the total rental amount. Cancellations made less than 24 hours before delivery, or no-shows, are subject to 100% of the total rental amount. Any product reductions or changes requested the day before delivery may be subject to a 50% restocking fee on the affected items.
If a requested item becomes unavailable, we reserve the right to provide a comparable substitute. We will make every effort to match the quality and functionality of the original item, and we will notify you of any substitution whenever possible.
Due to the nature of fabric dyeing and manufacturing, there may be slight variations in color between batches of the same product. We cannot offer refunds or exchanges for minor color variances, as these are inherent to the production process. Every linen that leaves our facility is hand-pressed with care.
Our items are frequently rented and professionally cleaned. While we work hard to provide the best quality every time, rental items may show signs of ordinary wear and tear. We cannot guarantee new or like-new condition on every item.
All items are provided "as is." ABC Party Center makes no warranties, express or implied, including any warranty of fitness for a particular purpose. Our liability is limited to repairing, replacing, or refunding the rental price of any item found to be defective, at our discretion.
ABC Party Center shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of use, lost profits, cost of substitute goods, or damages to other property. Our total liability for any claim shall not exceed the rental amount paid for the applicable items.
Nothing in these terms shall be construed to limit ABC Party Center's liability for personal injury or death caused by our own negligence, or for any liability that cannot be excluded or limited under applicable New Jersey law.
We are not liable for delays or non-performance caused by events beyond our reasonable control, including but not limited to severe weather, natural disasters, strikes, government actions, or supply shortages. In the event of such circumstances, we may cancel or reschedule affected orders without penalty.
ABC Party Center does not provide any insurance coverage in connection with the rental of items. Customers are encouraged to obtain their own event insurance.
These Rental Terms are governed by the laws of the State of New Jersey. Any disputes arising from these terms shall be resolved in the courts of Morris County, New Jersey.
If any provision of these Rental Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
These Rental Terms, together with your order confirmation, constitute the entire agreement between you and ABC Party Center regarding the rental of items. No verbal promises, representations, or side agreements shall modify or supplement these terms unless confirmed in writing by ABC Party Center.
You may not assign or transfer your rental order or any rights under these terms to any other person or entity without the prior written consent of ABC Party Center.
ABC Party Center's failure to enforce any provision of these terms shall not be construed as a waiver of that provision or the right to enforce it at a later time.
We may update these Rental Terms from time to time. The most current version will always be available on our website. Continued placement of orders after any changes constitutes acceptance of the updated terms.
